Corporate Counsel (Employment & Litigation) at Rain Instant Pay Rain is the fastest-growing earned wage access (EWA) fintech in the U.S., serving 2.5 million employees and backed by top investors, such as QED and Prosus. Rain is seeking to hire an attorney who has experience working on a range of employment-law matters and on issues of civil litigation that are relevant to the Company’s lines of business and operations (e.g., contractual disputes or other issues with service providers). In addition, the attorney in this position will be responsible for working on certain contracts, including the administration of standard contracts that the Company uses in its operations. The attorney in this position will report directly to the Company’s General Counsel. The position is designed to be Corporate Counsel, with opportunities for advancement and promotion in the Company’s Legal Department. What you’ll do Core areas of responsibilities will focus on separate, yet overlapping, areas of the Company’s Legal Department: (A) Employment-Law; (B) Litigation; and (C) Contracts.

  • Employment-Law: You will provide day-to-day employment legal advice to the Company’s People team, including advice relating to the Company’s internal policies. You also will be the principal attorney responsible for addressing the Company’s interests in potential claims by individuals or other persons relating to employment-law issues.
  • Litigation: You will be the principal attorney responsible for providing legal advice relating to the Company’s potential or threatened claims, as well as any civil actions taken by or against the Company. You will be responsible for assessing potential risks to the Company (whether as potential defendant or potential claimant), and provide analyses of options that the Company could consider in settlement discussions.
  • Contracts: You will be trained to administer the standard contracts that the Company has developed for its core areas of operations—and expected to apply your own expertise, good judgment, and professional skills to improve the administration of those contracts going forward. As part of your responsibilities for working on contracts you may be called upon to help the Sales teams with concerns or questions raised from time to time by the Company’s business customers or other counterparties.

Taken together and over time, the attorney in this position should be striving to work in a more senior position in the Company’s Legal Department. For each core area of responsibilities, you will be expected to research the applicable or potentially relevant areas of law, analyze the contracts or other instruments that may grant rights to (or impose obligations on) the Company, and prepare written analyses to the General Counsel. Apart from two core areas of responsibilities (i.e., employment-law matters and litigation issues), you will be expected to enable the Company to succeed in its business lines and operations by performing the following functions:

  • Advise on and lead investigations of whistleblower-related matters;
  • Advise on interpretations of existing or forthcoming contracts, including agreements with service providers, and, from time to time, take the lead to support the General Counsel for several types of contracts; and
  • Advise on, and collaborate on, revisions to the Company’s internal policies and procedures, including policies do not relate to employment-law matters.

Who you are

  • Juris Doctor from an ABA-accredited institution and admitted to state bar in good standing
  • Minimum of 4 or more years of experience at a major law firm or corporate legal department
  • Minimum of 4 or more years of experience with human resources and employment-law matters, addressing issues arising under federal and state employment laws
  • Experience in commercial civil litigation or employment-law litigation
  • Experience reviewing existing- and new regulations and advising clients on adapting its operations to comply with employment-law requirements
  • Experience handling employment litigation, administrative issues, and arbitration of employment claims before AAA, JAMS, or other arbitration forums
  • Experience in reviewing and revising contracts, apart from employment-law matters
  • Sharp attention to detail and diligence to accurately explain, orally and in writing, the facts, circumstances, and applicable law that bear on the resolution of a matter
  • Experience with counseling clients on whistleblower claims and managing investigations relating to those claims, including reporting requirements
  • Strong interpersonal skills, experience in organizing multiple assignments, and ability to work across varying levels of priorities
  • Independent, self-starter capable of developing solutions that address the Company’s near- and long-term interests in related matters or areas of law

Note these figures represent a range and the Company takes into consideration a variety of factors when determining total compensation for the position.
